Using Boom Logos, Badges, Trademarks, And Service Marks

This article covers the guidelines regarding the use of Boom Learning's logos, badges, trademarks, and service marks (our Brand identifiers). If you have any questions regarding these rules, please contact our marketing team at marketing@boomlearning.com

You are not required to use any of our logos, badges, trademarks, or service marks. If you choose to use them, your use must follow these guidelines. If you do not follow the guidelines, you will be asked to stop using the mark or logo improperly to preserve our legal rights to the mark or logo.

A Little Lesson in Trademark Law 

Understanding Brand Identifiers  

A “brand” identifier helps you know that a product or service that you are using was made by a particular company. Brand identifiers can become trademarks if the company takes steps to preserve the use of the brand to identify only products associated with the company. 

The Velcro company provides some very helpful examples. Velcro® is a brand of hook and loop fasteners. Velcro® is the brand. Hook and loop fasteners are the product type.  Velcro without the ® is the company name. Here is an example that correctly uses all three concepts:

I bought Velcro® fasteners to hang my picture frames. I like the ones made by Velcro better than those made by other companies. 

 

Understanding “First Instance” and Proper Use of Boom™ 

The “first instance” refers to the first time you mention a trademark (like Boom™ Cards or Boom™ Passport) within any single piece of content—whether that’s a product listing, email, webpage, flyer, or social media post. If you're not sure where the first instance is, simply use the ™ symbol on the most prominent or eye-catching mention. 

Example: 

Correct

“Our new set of Boom™ Cards focuses on phonics skills for early readers. These Boom Cards are self-grading and great for centers.” 

Incorrect

“Our new set of Boom Cards focuses on phonics skills for early readers. These Boom Cards are self-grading and great for centers.” 

 

Boom Learning’s Brands and Trademarks 

Boom Learning is our company name. We provide a learning platform to make and deliver digital teaching resources. Our brands include: 

  • Boom™ Cards - digital teaching resources made on the Boom™ Learning platform regardless of where sold 
  • Boom™ Learning - the platform that permits the making and delivery of Boom™ Cards digital teaching resources 
  • Boom™ Passport - the subscription service that delivers curated Boom™ Cards digital teaching resources to schools   

For all of our brands, our “word” trademark that identifies the brand as associated with Boom Learning the company is Boom™. We also have certain logos associated with our brands. Those are also trademarks. 

Boom Learning can use its trademarks as it sees fit. Everyone else can only use them if they follow our rules. To preserve our trademark rights, we will ask you to correct any misuse or outdated use.  

 

The Rules for Using the Boom™ Trademark  

These are the rules for using our trademarks. The rules exist to avoid confusing customers about the source of Boom Learning’s services. You may never use our trademarks in a way that implies that you are the source of the Boom™ platform or service or that any other company is the source of the Boom™ platform or service. 

Choose the Correct Phrasing

When talking about resources you or others made on the Boom™ Learning platform, you may use the phrase Boom™ Cards. You can instead use your unique brand. For example “Little Mind exit tickets” or “Education Everyday task cards”. Do not combine our branding and yours in a way that can confuse the user about the source of the materials you are providing. So you should not say: “Little Mind Boom Cards”. You can say, “I created Boom Cards for transition skills” or “These Boom Cards are great for learning math facts.” 

 

Always capitalize “Boom Cards” when referring to products made on the Boom™ Learning platform. This helps clearly distinguish the brand from generic terms and reinforces trademark usage. Do not write “boom cards,” “Boom cards,” or “BOOM cards.”

Incorrect: boom cards, Boom cards, BOOM cards. Boomcards 

Using the correct capitalization shows respect for the brand and helps protect our trademarks. 

 

When talking about our curated subscription product for schools, you may describe it as Boom™ Passport. 

When talking about the platform you use to make or sell decks, you may describe it as Boom™ Learning. It is also permitted to call it the Boom™ Learning platform. 

When talking about us as a company, use Boom Learning (no ™ symbol). 

 

Choose the Correct Formatting

When you use any of our brands, you should not use distinctive formatting to set them apart. Our brands should be used inline, in your text, with the same formatting as the text on either side. In general, you should not use Boom Cards on your covers in a way that suggests that you are the brand owner of Boom Cards. 

 

Using the ™ Symbol 

The first time you use a trademark in a document or material, include the ™ symbol. If the most prominent use of the trademark is not the actual “first use”, you can instead include the ™ symbol with the most prominent use. To get the ™ symbol, enter an HTML editor and type  ™. At the end of any text using our trademarks, such as a product description or a blog, insert our trademark disclaimer: Boom™ is the trademark of Boom Learning. Used with permission. If you use our logo or trademarks on a product cover, the disclaimer must be in the product description or accompanying materials.

Logos and Badges

Our logos and badges are images that identify us as the unique source of Boom Cards and Boom Passport. This section describes logos you are permitted to use when referring to Boom Learning’s brands. Any logo not listed on this page is RESERVED to Boom Learning. 

You may use the logos shown below if you follow these instructions: 

  1. The area around the logo is uncluttered and unobstructed. You may not overlay them with other images or text. 
  2. They must always be used on a solid background. Do not place logos over a photograph or textured background. The background must be of sufficient contrast that the logo or badge is readable. 
    1. With regards to Hosted On logos, we recognize that Publishers often include their own branding prominently on their covers. To support creative freedom and minimize unnecessary restrictions, we do not require specific placement of Boom™ logos or badges. If fact, you are not required to use them at all. If you do use them, please follow the visual clarity and size rules. You may position the logo in a way that complements your existing design. 
  3. Logos and badges cannot dominate the graphics in your layout. 
  4. Do not change the color or graphics. 
  5. Do not distort the badges. Maintain the original dimensions if you resize. 135 x 40 is the smallest allowable size for rectangle badges. The smallest allowable size is 70 x 70 pixels for square badges. 
  6. You must strictly follow the specific instructions that apply to each logo or badge. 
  7. You may not create your own version of our logo with stylized text and our word mark. 

 

b-star tile logo (2021)  

The b-star tile logos may be used on your cover images, thumbnails, descriptive materials, website, and on advertising materials in connection with promoting or describing Booms Card decks in general or Boom Card decks created by you. "Boom Cards" means products created using the Boom platform and hosted by Boom Learning. 

If you use the b-star tile logo, the URL associated with it must point to a listing for one of your Boom Cards products on any marketplace. 

You may use the Boom Cards b-star logos in the tile format displayed below and attached to this help page. You may not remove or render transparent the white or blue background tile behind the logo.

The Hosted on Logos 

You may download and use the "hosted at" logos attached to this help file to signify a Boom Cards product you create is hosted at www.boomlearning.com. They must be legible in all marketing communications. Only include one logo per message.

Compatible With Usages (including Google Classroom) 

You may describe Boom Cards as compatible with Google Classroom™ in one of these ways 

  • Assign Boom Cards decks with Google Classroom™ 
  • Boom Cards decks are compatible with Google Classroom™ 
  • Compatible with Google Classroom™ 
  • For use with Google Classroom™ 

 

You may use similar terms (substituting the product name) for other services that permit you to assign by URL such as Microsoft Teams, SeeSaw, PowerSchool, Blackboard, Canvas, Moodle, and more. 

The key is to use the brand name as a noun and NOT as an adjective. 

Okay: Assign Boom Cards decks with Google Classroom Not Okay: Google Boom Cards

Smart Media Logo - Deprecated 

Do not add new Smart Media logos to websites or promotional materials. Smart Media logos should never be added to deck covers. 

 

License Agreement

By using our marks, logos, and badges (the "Marks") you are agreeing to the terms in this document. Failure to abide by these terms immediately terminates your rights to use the Marks. You are not required to use our Marks, but if you do use them, you must follow these rules. 

Subject to your compliance with the terms and conditions of this document, Omega Labs Inc. dba Boom Learning ("Boom Learning"), a Washington corporation, located in Kirkland, WA, grants you a non-exclusive, personal, and nontransferable license to use the Marks to identify and promote Boom Cards or Boom Learning. You agree you will not use, register, or attempt to register any company name, product name, domain name, user name, email address, or URL incorporating any of the Marks or any combination of letters similar to any Mark. 

You agree that you will not at any time do, or cause to be done, any act or thing which in any way suggests, directly or indirectly, that Boom Learning approves or sponsors you or your products or services or that you are, for any purpose, an agent of Boom Learning. 

You agree to comply with these instructions and directions regarding the use, appearance, and placement of the marks, including as they may be updated from time to time. You will not alter the nature or design of the Marks in any way and will not use the Marks in the creation of a composite mark unless prior consent is obtained from Boom Learning. 

This license shall be in effect from your first use of a Mark until (a) you terminate your rights by violating a term of this agreement or (b) Boom Learning informs you that your right to use the Marks has been terminated. Upon termination, all rights granted will automatically terminate. Boom Learning will not be liable to you for any license termination, including loss of goodwill, prospective profits or anticipated sales, or any expenditures, investments, or commitments made relating to this license. 

The Marks are protected by copyright, trademark, and other intellectual property laws and are owned exclusively by Boom Learning. Nothing in this license shall be construed or interpreted as granting you any rights of ownership in or any proprietary rights to the Marks. ALL RIGHTS NOT EXPRESSLY GRANTED HEREIN ARE RESERVED TO OMEGA LABS INC. The terms of this license are supplemented by and in addition to the Boom Learning Terms of Service. 

 

Reserved Marks - For Use Only By Boom Learning

All marks for which we do not grant permission for use in your materials, as outlined in this document, are explicitly RESERVED exclusively for our use. The following marks are specifically reserved and may not be used by you.
